David is a trial lawyer focusing on insurance coverage disputes.

He provides strategic evaluations and insights that help global insurance carriers across the country assess their exposure and avoid litigation, bringing his experience and analytical skills to bear on a variety of risk management issues. Closely monitoring developments in the insurance industry, David ensures his clients are aware of developing case law and changes in the regulatory and legislative landscapes that may impact their business. He always works with the client’s business goals in mind—and with decades of experience in insurance litigation, he’s very familiar with the business concerns of insurance companies.

When litigation is necessary, David works closely with in-house counsel to create and implement a strategic plan for resolution. He has experience in handling claims and lawsuits throughout the country, encompassing a wide variety of policy types, losses, and disputes, including hurricanes and other natural catastrophes, personal injuries, environmental liabilities, construction defects, reinsurance disputes, arbitrations, class actions, and bankruptcy proceedings, among others. He also advises clients on critical and evolving issues like bad faith, the allocation of liability among multiple insurance policies, and ethical obligations in insurance relationships.

David’s priority is always open, frequent communication with clients. He is aware that litigation is a stressful process for companies, and he understands the high stakes involved. As a result, it’s important to him that clients understand his legal analysis, play an active role, and have confidence in his strategy. David’s goal is to remain in touch and accessible.

  • Obtained summary judgment dismissing breach of contract and bad faith claims against insurance company arising from damages awarded against a construction company for exterior panel defects.
  • Secured dismissal of claims against insurance company under Environmental Impairment Liability (EIL) policies for cleanup costs and personal injury claims arising from multiple sites throughout the United States.
  • Obtained summary judgment in favor of insurance company in a claim for business interruption losses arising from Hurricane Rita evacuation orders.
  • Secured dismissal of contractual and extracontractual claims against insurance company based on environmental remediation costs at California refinery.
  • Negotiated settlement agreement and insurance policy buyback, and successfully challenged objections lodged by various parties, in insured’s bankruptcy proceeding following chemical spill into river in West Virginia and resulting class actions against insured and its officers.
  • Secured summary judgment dismissing claims against insurance company on a claim under a marine services liability policy for the defense of a lawsuit alleging that the insured negligently installed and repaired a vessel’s engines.
  • Obtained reversal on appeal of order allowing jurisdiction over Mexican insurance company in Texas state court for claims arising explosion at candy manufacturing facility in Juarez, Mexico.
