Overview

When moving into new locations in commercial real estate, it is not uncommon to have unexpected delays. If you aren’t properly protected and haven’t addressed timeliness in your previous and new leases, fees and penalties can be significant. We negotiated a lease provision stating that the tenant (our client) would receive a day-for-day rent credit until the landlord delivered the premises with the tenant improvements substantially completed and an executed SNDA. After unplanned late delivery did occur, our client was entitled to approximately $300,000 of reimbursement.
