Situation

A large Midwest contractor sought to defend a suit by a subcontractor alleging more than $3.1 million in delay and inefficiency damages, as well as an additional $44,000 in requested change orders, related to the renovation and expansion of a hospital.

Result

In the decision, received two months after the post-trial briefing, the judge agreed with virtually every defense argument our team presented by our team. The judge rejected claims for delay and inefficiency and awarded $8,436 for a few outstanding change orders, or roughly 0.27 percent of the plaintiff’s claim.
