Husch Blackwell Assists Innergex in Bringing Phoebe Solar Online

Biggest Solar Energy Project in Texas History Begins Commercial Operation

Husch Blackwell served as legal counsel to Innergex Renewable Energy Inc. (“Innergex”) in the recently announced full commissioning of the Phoebe solar photovoltaic farm. The Phoebe project is expected to generate power sufficient for 50,000 households, and at 315 MWDC, is the largest solar farm in the state of Texas. Total construction costs should amount to approximately $397 million.

Husch Blackwell provided comprehensive Texas legal advice in assisting Innergex to reach project completion. The firm provided real estate and construction law advice, as well as state and federal regulatory and environmental law assistance for the 3,500-acre project comprised of 768,000 photovoltaic solar panels.

“It has been our deep pleasure to provide legal counsel to Innergex in getting this project across the finish line,” said Cacki Jewart, the lead lawyer for Husch Blackwell on the Phoebe project. “We served as development counsel to the previous owner who sold the Phoebe project to Innergex in July 2018, so to be retained by Innergex and, now, to be able to see the project through, has been very satisfying.”

The total output from the Phoebe solar project will be sold to the ERCOT power grid and 89% of the energy produced will receive a fixed price under a 12-year power purchase agreement with Shell Energy North America. The remainder of the project’s output will receive a merchant market price.
