Husch Blackwell Secures Federal Circuit Victory for Luv N' Care

Husch Blackwell prevailed yesterday before the US Court of Appeals for the Federal Circuit on behalf of client Luv N’ Care, Ltd., a leading manufacturer and distributor of baby accessories, in connection with a patent dispute relating to leak-proof product designs for drinking containers.

Previously, Husch Blackwell had successfully initiated post-grant proceedings before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office, challenging a patent (U.S. Patent 8,739,993 B2) that Munchkin, Inc. had attempted to assert against Luv N’ Care in related litigation in U.S. District Court, Central District of California.

While the district court litigation was stayed, the PTAB completely vindicated the Husch Blackwell position, holding that all of the patent’s claims are invalid and unpatentable. The Federal Circuit affirmed the PTAB’s Final Written Decision, providing Luv N’ Care with a full victory.
