Kansas: State-by-State Summary of Prompt Payment

Owner to Prime Contractor (Private): 30 days following receipt of request for payment.

Prime Contractor to Subcontractor (Private): 7 business days of receipt of payment from owner

Interest/Penalties (Private): Interest at a rate of 18% per annum. Attorneys’ fees awarded to prevailing party.

Owner to Prime Contractor (Public): Unless otherwise agreed by contract, 30 days after receipt of invoice, except that extenuating circumstances will extend timing for payment to 45 days.

Prime Contractor to Subcontractor (Public): 7 days business days after receipt of payment from owner.

Interest/Penalties (Public): Private projects: interest at a rate of 1.5% per month; Public projects: interest at a rate of 18% per annum.  

Pay-If-Paid Permissible: Yes, for private contracts only. However, clause cannot be used as a defense to a lien claim.
