Wendy Arends, Nick Healey, and Shawna Ruetz will present, "FTC: Changes Rules Around Non-Compete Clauses," on Tuesday, June 18, 2024, at the Wyoming Medical Society (WMS), which has partnered with the Wyoming Hospital Association and Husch Blackwell.

The Federal Trade Commission (FTC) recently finalized and voted 3 to 2 to approve its much-anticipated rule banning non-compete agreements between employers and employees. Although early versions of the rule had largely excepted hospitals, the final rule does not, and the FTC has noted that physician non-competes are a specific target of this rule. However, how the rule applies to non-profits and local government entities, both of which have a large presence in healthcare in Wyoming and which the FTC doesn’t have jurisdiction over, is murky.

In addition, industry groups have already sued the FTC (in Texas and Pennsylvania) to void the rule, but it remains to be seen whether those efforts will yield results before it goes into effect. Join the the panel to hear about how the FTC’s rule may apply to Wyoming hospitals and physicians, and how best to prepare for complying with the rule.
