Join Husch Blackwell’s Higher Education attorneys for a Title IX series that prepares your team to respond to sexual misconduct complaints at all stages, from initial case processing to investigation, and from a hearing through an appeal. Our live virtual series is interactive and includes relevant scenarios, best practices and time for discussion and questions. Our attorneys will also address Title IX regulatory requirements, including new policy developments under the Biden Administration. Materials are designed for institutions to post on their websites in order to comply with federal regulatory training requirements.

The May 13th program includes best practices for pre-hearing conferences, preparing for and conducting a hearing, addressing common curveballs in hearings, as well as decision-writing. Critical concepts include:

  • Introduction to hearings
  • Hearing procedures
  • Relevancy and key evidentiary concepts
  • Effective questioning for hearing panel members
  • Facilitating effective cross-examination by advisors
  • Sanctioning considerations, including aggravating and mitigating factors
  • Decision-making
  • Report-writing considerations including credibility analysis

Who Should Attend
College and university investigators and adjudicators of sexual misconduct; Title IX coordinators, deputy coordinators and investigators; HR professionals; hearing officers and panel members; appellate officers; and other related team members.

Workshop Cost
$400 per person. Fee includes full-day virtual program and materials. Payment can be made via check or credit card. Register for all four trainings by April 30th and receive a $50 discount on each session – a total discount of $200.

Continuing Education Credit
All four programs are pending approval for Arizona, Colorado and Nebraska continuing legal education credit and HR Certification Institute and Society for Human Resources Management recertification credit. A certificate of attendance will be provided after the program and can also be used for continuing education self-study reporting.

  • Coordinators & Investigators Training | May 6 (9am – 5pm MDT) – In this module, we explain policy requirements and case processing considerations to address Title IX and Violence Against Women Act (VAWA) complaints. This training provides a deep dive on critical topics and common scenarios for investigators and coordinators, including:
    • Key legal principles and considerations
    • Applicable legal, regulatory and policy requirements in a changing environment
    • Case processing
    • Investigative issues, including effective questioning, responding to common fastballs in investigations, report preparation and sharing practices
    • Trauma-informed investigative practices
    • Conflicts of interest, bias and stereotyping
    • Resolution options and processes, including informal resolution
    • What coordinators and investigators should know about hearings and appeals
  • College & University Advisors Training | May 20 (9am – 12:30pm MDT) – This training focuses on the important role of appointed advisors in the hearing phase of the Title IX process, including the advisor’s role in conducting cross-examination at the hearing and avoiding foreseeable issues. Critical concepts include:
    • Title IX fundamentals
    • The role of college and university advisors and best practices
    • The various forms of prohibited sexual harassment
    • How to avoid conflicts of interest, bias and stereotyping
    • Relevancy and key evidentiary concepts
    • How to prepare for and conduct effective cross-examination at the hearing
  • Appeal Officials Training | May 27 (9am – 12:30pm MDT) – Using real-life scenarios, this training provides an overview of the underlying appeal process through the written appeal decision. Handling cross-appeals and common curveballs are also covered. Critical concepts include:
    • Title IX fundamentals for appeals officials
    • Appeal procedures including common grounds for appeal
    • Appeal outcome options and best practices
    • Preparing a strong written appeal decision
