On July 3, 2018, the Department of Justice and Department of Education withdrew Obama-administration guidance to educational institutions on the extent to which schools may consider race as a factor in achieving diversity. The Departments’ actions may signal a shift toward discouraging the use of race-conscious programs to achieve diversity and could impact how private and public institutions structure their admissions practices.
