Overview

Dieter is a trial attorney focusing on complex, high-exposure business and insurance coverage disputes.

Dieter has handled all phases of litigation, including pretrial hearings and motions, trials, and appeals in state and federal court in all regions of the United States.

Dieter has worked on a broad array of insurance coverage matters involving nearly every kind of insurance policy, including layering and allocation coverage issues under multiple insurance policies, bad faith claims, environmental disputes and professional liabilities.

He also regularly defends companies ranging from startups to large corporations and other stakeholders in a wide variety of quickly moving business-to-business matters that can involve injunctions and restraining orders. He assists clients with noncompete agreements, trade secret claims and franchise disputes, among other issues.

Dieter is a passionate litigator who advocates to protect client interests and business assets. He enjoys the day-to-day complexity of guiding clients through sensitive business issues. His goal is to work hand in hand with clients to develop a game plan and then assertively execute that plan.

Represented franchisee against worldwide vehicle manufacturer in fair dealership dispute.
Represented insurer in arbitration regarding number of applicable policies in which panel found in favor of client, resulting in significant cost savings.
Represented insurer in arbitration over applicability of coverage under site pollution liability policy regarding historical pollutant, resulting in favorable settlement.
Represented national packaging manufacturer pursuing breach of fiduciary duty and tortious interference claims against former executive.
Navigated expedited negotiations, hearings and discovery for state insurance department client in disputed rehabilitation and subsequent liquidation proceedings. Team counsel avoided trial, resulting in significant client cost and time savings, thus preserving and maximizing estate assets.
Successfully defended insurer in federal court against claims of breach of duty to defend and bad faith. Matter settled for less than 5 percent of plaintiff's alleged damages following motion practice.

Dieter enjoys golfing, and is a baseball and football fan, particularly of the Milwaukee Brewers and the Green Bay Packers. He and his wife stay busy with three young children, who love attending – if not exactly watching – games with their parents.
