With a 30+ year career as a trial attorney who has obtained rulings that have changed legal definitions, Kelley is a fierce advocate for clients.

Kelley represents clients in a wide variety of complex commercial litigation matters. She is board certified by the Florida Bar in Business Litigation and Civil Trial and concentrates her practice in commercial and business litigation, construction and real estate litigation, employment litigation, and trusts and estates litigation. Kelley represents individuals, corporate clients, family businesses, private companies, and professionals in a wide variety of matters including contract disputes, shareholder/partnership disputes, business torts, construction law, securities litigation, and employment law (representing employers only). In her employment litigation practice, Kelley represents employers in litigation and dispute resolution at the administrative agency level, as well as in court.

Kelley has litigated extensively in state and federal courts, handling matters across a broad spectrum of industries, including construction, banking, healthcare, manufacturing, broadcasting and media, real estate, and securities. The clients she serves include public and private companies, high net worth individuals, and family businesses. Kelley takes pride in her client relationships, many of which span decades, and works closely with clients and their businesses, not only in litigation but by providing practical and meaningful advice and counseling on a wide variety of legal issues.

While Kelley works with clients from a diverse array of industries, she is particularly focused on real estate and construction, frequently representing developers and contractors and reviewing or preparing construction contracts for projects that range from single family residences to massive commercial shopping centers.

Kelley’s natural habitat is the courtroom, and she has a deep passion for trying cases. She frequently represents clients in both bench and jury trials and—unusually for a Florida commercial litigator—has the high volume of jury trial experience necessary to qualify for the Florida Bar’s Certification in Civil Trial Law. Kelley is known for her excellent memory for facts and details, her gift for thinking on her feet, and her ease at relating to juries—an often-overlooked but significant element in trials. She has secured victories for clients in state and federal court and on appeal. Prior cases have led to clarification of the statute governing unlicensed contractors in Florida, a jury’s role in awarding damages in invasion of privacy claims, and a change in the definition of a “security” under Florida law.

A crucial part of the firm’s growing Southeast presence, Kelley’s practice is primarily Florida-based but stretches throughout the country. She often builds decades-long relationships with clients and seeks to understand their businesses and industries on a cellular level. Known as an aggressive advocate for clients’ interests, Kelley has built a stellar reputation for her in-depth knowledge of clients and their needs.

Experience
  • Represented clients in securities case involving purchase of stock in closely-held media education business, securing $2.2 million final judgment with attorney's fees. An en banc appeal also led to change in the legal definition of a "security" in Florida.
  • Represented media company in invasion of privacy case brought by ex-partner of radio personality. Judge directed verdict in favor of client after week-long jury trial; one remaining claim settled after appeal.
  • Represented developer client in case leading to clarification of the statute governing unlicensed contractors in Florida.
  • Represented client in breach of agricultural contract claim and in defense of a counterclaim for total destruction of business seeking damages in excess of $2,000,000. After week-long jury trial, obtained verdict in favor of client on all claims and defeated the counterclaim.
Outside the Office

Most of all, Kelley enjoys spending time with her friends and family, including her two adult children, as well as her two Boxer dogs. She also loves to read, cook, and travel and has a vast bucket list of places she still needs to visit.

A classic Floridian, Kelley can often be found at the beach, attending a Gators football game, or relaxing at her lake house in north Florida.

Community Leadership

Kelley has close ties with several legal aid organizations and has worked with the Legal Aid Service of Collier County for more than 20 years. During her term as president of the Collier County Bar Association, she led the creation of the “Collier Lawyers Care” pro bono program the organization still offers. She is also a long-time member of LASCC’s Advisory Board where she has founded several projects, including the Foreclosure Task Force in 2008 and the annual Wills for Heroes Program.

Kelley also serves on the Board of Directors for the Naples Players, a local theatre company.
