Overview

An experienced litigator and advisor, Stuart serves clients on insurance coverage disputes and other complex commercial matters.

Stuart has significant experience across many lines of insurance, including general liability, product liability, representation and warranty, environmental liability, directors and officers, commercial property, errors and omissions, product recall, and aviation coverage. Stuart has appeared on behalf of plaintiffs and defendants in federal and state courts and in alternative dispute resolution proceedings. He has directed pre-litigation negotiations, guided matters through discovery and motions practice, argued appeals, and negotiated favorable settlements.

Stuart’s practice encompasses matters involving a wide range of industries, including telecommunications, manufacturing, pharmaceutical, public affairs, and commercial development. In addition to his litigation work, Stuart advises clients on the legal implications of various business insurance issues, including coverage placement, asset transfers, as well as claim submission and processing. He also guides clients with respect to insurance strategies in mass tort bankruptcies.

Prior to joining Husch Blackwell, Stuart worked at an insurance litigation boutique in Washington, DC, where he represented policyholders in litigation that spanned nearly every type of insurance coverage. Stuart began his career as associate at an Am Law 5 firm in Chicago, where he litigated complex commercial matters on behalf of corporate and individual clients in state and federal courts.

Experience
  • Managed toxic tort matter for safety equipment manufacturer involving decades of historic occurrence and claims-made coverage responsive to asbestos, coal, silica, and PFAS claims.
  • Directed negotiation and settlement of representation and warranty claim stemming from fraudulent revenue reporting by telecommunications executives prior to corporate acquisition.
  • Served as insurance counsel for public company during complex transaction which transferred tort liabilities and responsive assets via spinoff of corporate subsidiary.
  • Negotiated high-value settlements on behalf of Chapter 7 bankruptcy Trustee seeking coverage for tool company manufacturer's pre-bankruptcy liabilities.
  • Litigated federal court action concerning rescission of aviation insurance policy, on behalf of international development company.
  • Argued appeal of insurance claim classification on behalf of insured corporation in Texas state court receivership proceeding.
  • Worked closely with in-house counsel of consumer products manufacturer to manage claims tendered by numerous retailers seeking indemnification for actions alleging exposure to talc-containing products.
  • Guided clients pursuing trade and investment opportunities in Cuba, including facilitating several of first commercial imports of Cuban goods to U.S. in over 50 years and managing U.S. regulatory compliance for cultural events held in Cuba.
  • Obtained payment of full policy limits for lobbying firm and its directors in D&O claim stemming from alleged breaches of Foreign Agent Registration Act.
  • Litigated environmental coverage action seeking recovery for costs associated with CERCLA remediation action.
  • Advised pharmaceutical client's in-house team on placement of comprehensive insurance portfolio, including CGL and D&O policies.
  • Represented Tort Claimant's Committee and Future Claimant's Representative in Chapter 11 bankruptcy proceeding stemming from industrial and cosmetic talc liability.
Outside the Office

Stuart is a wine enthusiast who has completed WSET certification coursework in wine. Stuart is also an avid music lover, and as an undergraduate at Duke, he taught a course on the history of popular music. In his spare time, Stuart enjoys playing guitar with friends and listening to records with his daughter (Evangeline), his dog (Marvin Gaye), and his cat (Rick James).

Community Leadership

Stuart prioritizes pro bono work and has handled asylum cases, educational access, and Individualized Education Plan (IEP) trials on behalf of students and their families, and pro bono insurance coverage matters. He has previously led fundraising efforts for the Legal Aid Society of DC.
