Tim’s litigation practice involves complex business disputes and commercial litigation, ranging from membership/shareholder/partner disputes in closely held companies, business separations, franchisor-franchisee disputes, breach of contract, False Claims Act litigation, healthcare law, insurance disputes related to the payment and processing of healthcare claims, landlord-tenant disputes, business torts, wrongful death actions against companies, and other complex cases. Tim’s prior background and substantial experience in the healthcare space help him advise and guide clients’ litigation matters through a complex regulatory environment.

With a knack for problem-solving and a persistent work ethic, Tim thrives on digging deep into the facts of a dispute, assessing the risks, strategies, and other considerations to align the litigation strategy with the clients’ goals. Tim uses this information to determine the most effective path to victory. Husch Blackwell recovers $350,000 of previously uncollectible assets for client

When a client came to Husch Blackwell with a judgment against an individual in their noncollectible asset category, Tim and his team dove into background research to identify assets that could be used toward collection of the judgment. Tim and his team conducted extensive discovery to identify the assets that would provide the highest return on investment for the client. After several days of hearings, the judge granted the requested release, allowing our client to recover over $350,000 – 85 percent of the previously uncollectible judgment.


Additional Experience
  • Represented health insurance clients in various arbitrations involving issues related to various contracts for medical services, billing for medical services, payment of claims for medical services, and other issues related to the processing and payment of claims for medical services.
  • Represented a hospital client in a pre-mediation dispute against a healthcare insurance payor related to the various medical claims for services, billing for these claims, and the reimbursement rates for these claims.
  • Defended health insurance clients against claims for breach of contract, a violation of the Texas Deceptive Trade Practices Act, fraud, violations of various provisions of the Texas Insurance Code, and other claims related to the provision of health insurance.
  • Represented rural hospitals in a contract dispute with their electronic health record provider over various contractual issues, performance standards with the software, and payment obligations, resulting in a settlement of all claims.
  • Obtained a temporary restraining order for a landlord of skilled nursing facilities against its tenant involving the non-payment of rent and other obligations under the parties' agreement. After obtaining the temporary restraining order, the case was resolved through a million-dollar agreed judgment in the landlord's favor.
  • Defended a physician group in connection with the ouster of a founding member of the physician practice and competing claims for ownership and distributions from the practice, resulting in a settlement.
  • Defended a physician practice against claims from former physicians/members related to retirement benefits and/or continued distributions under the organizational documents, resulting in a settlement.
  • Guided a closely-held corporation through a shareholder dispute involving the ouster of a former member and competing claims regarding ownership, shareholder rights, and shareholder oppression, resulting in a settlement.
  • Obtained summary judgment for a national healthcare provider named in False Claims Act litigation by a former employee alleging a novel theory of liability under the False Claims Act.
  • Obtained summary judgment and pretrial dismissals for physicians in cases alleging the physicians violated the federal False Claims Act and related state statutes.
  • Represented a national healthcare client culminating in a multi-week bench trial in a bet-the-company case involving competing contractual claims related to a franchisor-franchisee dispute.
  • Obtained a take-nothing arbitration award after a three-day hearing for a physician practice client in arbitration against former employees alleging fraud, breach of contract, and other partnership claims. The former employees alleged over $12 million in damages.
  • Represented a software startup company in a dispute with a developer over competing contractual claims and intellectual property by obtaining a temporary restraining order and temporary injunction against the developer.
Outside the Office

Tim is a thrill seeker who enjoys skydiving and bungee jumping.

One of his recent feats was rappelling down a 32-story office building in support of the Make-A-Wish Foundation. He also vacations with his family and coaches youth sports.

Community Leadership

Tim helps low-income individuals access legal aid by offering his pro bono services to Volunteer Legal Services of Central Texas. This rewarding collaboration has allowed Tim to assist community members work around foreclosure proceedings, find alternative living agreements and settle licensing issues that impact their earning capacity.
