Representative Experience

  • Represented the American Society of Composers, Authors and Publishers (ASCAP) and the Recording Industry Association of America in several copyright infringement matters.
  • Represented a manufacturer of chlorine and sodium hydroxide with various intellectual property matters, including technology licensing and trademark and copyright guidance. In 2010, led a Husch Blackwell team that helped this client negotiate a licensing transaction in which it acquired a key piece of new bleach-production technology, which it is now in the process of rolling out to all of its bleach-production facilities.
  • Managed all intellectual property-related work for one of the largest suppliers of rigid (glass and plastic) packaging in the United States, including utility and design patent prosecution, trademark and copyright guidance, licensing, and infringement matters.
  • Represented consumer goods company in copyright litigation against a major global retailer in connection with the defendant’s attempt to market and sell a knockoff version of the client’s product.
  • Obtained a favorable ruling in defending copyright infringement claims lodged against the Academy of Geriatric Physical Therapy by former volunteers who claimed ownership rights in the Academy’s valuable certification course materials last winter. After winning on summary judgment, the Academy sought recovery of their attorneys’ fees. The court granted their motion and awarded the Academy over $185,000 in fees and costs as the prevailing party.
  • Achieved a victory in a software copyright case on behalf of WOCCU Services Group (WSG). WSG undertook the development of ATM networks for credit unions in Central and South America. Such networks use transactional switch software to operate and WSG initially licensed such software from companies in Guatemala and Ecuador. When those software options proved to be unsatisfactory, WSG developed its own transactional switch software and terminated the license agreements, leading to four and half years of litigation involving two Federal Court lawsuits.
