Husch Blackwell Prevails on Behalf of Sichuan Tyre & Rubber Co. in Product Liability Dispute

A Husch Blackwell trial team secured the dismissal of Sichuan Tyre & Rubber Co., a Chinese tire manufacturer, in a product liability lawsuit filed in Hidalgo County, Texas.

The plaintiff alleged negligence and strict liability related to allegedly defectively manufactured and designed tires on his vehicle. The plaintiff alleged that the design and manufacture defects resulted in the plaintiff losing control of his 2010 Ford Expedition, causing injuries to the plaintiff and his family. The plaintiff also alleged that the tire shop was negligent in the installation of the Sichuan tire and that Ford was responsible for the defective design of the vehicle and those claims will continue to be litigated.

However, Sichuan exited early from this lawsuit after Husch Blackwell argued and the Court agreed that Texas courts do not have personal jurisdiction over Sichuan Tyre as it does not sell tires in Texas, distribute or ship tires to Texas, or market or advertise in Texas.
