Husch Blackwell’s Manufacturing law team partners with companies to develop long-term strategies for growth and reducing risk while resolving day-to-day issues. We advise companies in the chemicals, consumer goods, distribution, industrial goods, and raw materials sectors on transactional matters such as mergers and acquisitions, OSHA compliance, product safety, trademark and patent preparation and filing, and labor and employment. Our attorneys also guide new and established businesses on optimizing growth through the Internet of Things and other emerging technologies.
 
Additionally, our attorneys have extensive experience handling commercial disputes as well as toxic tort, product liability, class actions, intellectual property, and other litigation that can be a fact of life for manufacturers. Our team serves as regional and national coordinating counsel for several clients, including Olin Corp. and Bayer (formerly Monsanto). We also provide counseling on compliance, permitting and enforcement in substantive environmental matters, including land use, pesticide regulation, site remediation, toxic chemical regulation, and hazardous wastes.

Representative Experience

  • Handled an investigation into the safety testing of a baseball catcher’s helmet and drafted filings for US CPSC. Based on our findings, the Husch Blackwell team then led a recall in the US and Canada.
  • Represented a privately owned cleaning products company with its redevelopment and expansion of a corporate headquarters, including a manufacturing and distribution complex, in St. Joseph, Missouri. Worked with the client and the state of Missouri to develop an environmental risk remediation plan and secure Brownfields Tax Incentives to help with the expense.
  • Represented manufacturing company in connection with a multi-year audit of compensation practices by the U.S. Department of Labor, alleging exposure for unpaid time in the range of several million dollars. The Husch Blackwell team successfully persuaded the DoL to conclude its investigation without any finding or assessment of penalty.
  • Successfully represented manufacturing company in a two-count tort action concerning injuries suffered by a truck driver who alleged significant injury from a fall while on the client’s property.
  • Represented manufacturer of industrial refrigeration compressor which exploded at food processing facility. Took over the Ohio state court case during expert discovery. After disclosing new metallurgical and refrigeration system experts, deposing plaintiffs’ experts, and defending new defense experts’ depositions, our client won summary judgment on all counts.
